Official Rules
No Purchase Necessary to Enter or Win. A Purchase Does Not Improve Your Chances of Winning.
1. Eligibility
The FlashShield®+ Certified CSST Contractor Sweepstakes (“Sweepstakes”) is open only to natural persons who are certified CSST HVAC or plumbing contractors with a CSST certification number, as verified by Sponsor’s records, at the time of the Grand Prize drawings, and who are legal residents of one of the 48 contiguous United States or the District of Columbia, and who are at least eighteen (18) years old at the time of entry (each a “Qualified Participant”). This sweepstakes is not open to the general public or to plumbing and HVAC distributors or to Sponsor’s distributors or representatives. Void in Alaska, Hawaii, Puerto Rico, U.S. territories, possessions, and protectorates. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations, and is void where prohibited.
2. Sponsorship
The Sweepstakes sponsor is Titeflex Corporation, doing business as Gastite (“Sponsor”), located at 1116 Vaughn Parkway, Portland, TN 37148. Sponsor and its affiliates, subsidiaries, successors, and assigns, and their respective agents, representatives, officers, directors, shareholders, and employees, and the immediate family members of such individuals, and any entity involved in the development, production, implementation, administration, judging, or fulfillment of the Sweepstakes, including without limitation Eric Mower and Associates (“Administrator”), and its affiliates, subsidiaries, successors, and assigns, and their respective agents, representatives, officers, directors, shareholders, and employees, and the immediate family members of such individuals, are not eligible to participate. Eric Mower and Associates will conduct the Sweepstakes substantially as described in these Official Rules.
3. Agreement to Official Rules
By submitting an entry to participate in the Sweepstakes, each Qualified Participant fully and unconditionally agrees to and accepts these Official Rules and the decisions of Eric Mower and Associates, which are final and binding in all matters related to the Sweepstakes. Sponsor reserves the right, in its sole discretion, to refuse, disqualify or withdraw any entry at any time.
4. Timing
The Sweepstakes begins at 12:00:01 a.m. Eastern Time (“ET”) on April 1, 2020 and ends at 11:59:59 p.m. ET on December 31, 2020 (the “Entry Period”).
5. How to Participate
During the Entry Period, a Qualified Participant can enter the Sweepstakes by visiting the Sweepstakes Website at www.gastite.com/plus and follow the instructions to complete and submit the Sweepstakes entry form electronically. Electronic registration using this link is the only way to enter the Sweepstakes. No other method of participation or registration is permitted. Sponsor asks each Qualified Participant to watch a short video to see how new FlashShield®+ product innovations provide added protection and make FlashShield®+ easier to install. Viewing the video does not affect your eligibility to win. Registration requires a Qualified Participant to provide basic contact information, including your first and last name, company name, title, email address and telephone number (including area code) and confirm CSST certification. (Note: You must complete all required fields of the entry form with information that is valid at the time of the Grand Prize drawing to be eligible.) All entries become the Sponsor’s property, and none will be acknowledged.
6. Mobile Device Entry: Text and Data Charges or Wireless Internet Access Charges May Apply to a Mobile Entry.
Consult your wireless carrier’s rate plan for details before seeking to participate in the sweepstakes via a mobile device. Not all mobile devices may be used for mobile entry, and wireless internet access may not be available in all areas.
7. Limits on Entries
Upon successful submission of a registration, each Qualified Participant will receive one (1) entry into the Sweepstakes drawing for the region (see Rule 9 below) in which a Qualified Participant lives. Limit one entry per Qualified Participant. No third-party entry or entry through any sweepstakes service is permitted. Use of robotic entry devices is strictly prohibited. Any person who attempts to obtain or otherwise encourages the entry of multiple or false contact information under multiple identities or uses any device or artifice to enter or encourage multiple or false entries, or who attempts to obtain more than one entry by using multiple or different email addresses, identities, registrations, logins, or any other method, Will Be Disqualified, as determined by Gastite in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual found to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules, or in an unsportsmanlike or disruptive manner. Any dispute regarding ownership of an entry will be resolved by Eric Mower and Associates in its sole discretion.
Warning:
Any attempt by any person, whether or not a Qualified Participant, to deliberately damage, destroy, tamper with or vandalize any Sponsor-owned website or mobile application or related social networking site, the entry process, or otherwise interfere with or undermine the legitimate operation of the Sweepstakes, may be a violation of criminal and civil laws, and Sponsor reserves the right to seek damages and diligently pursue all remedies against any such person to the fullest extent permitted by law.
8. FIVE GRAND PRIZES WILL BE AWARDED—ONE PER REGION
A Weber® SmokeFire EX6 Wood Fired Pellet Grill, 36-inch, approximate retail value (“ARV”) $1,120.10 (including shipping and taxes). Prizes include delivery but does not include set-up. No more than one Grand Prize will be awarded in each Region. Winners agree to accept a Grand Prize “as is,” and Qualified Participants acknowledge that neither Sponsor nor Administrator is in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the Grand Prize, including without limitation warranties provided exclusively by a prize manufacturer or supplier, or warranties as to the Grand Prize’s quality, merchantability, or fitness for a particular purpose. Any difference between the stated ARV value and the actual value of the Grand Prize will not be awarded. Winner must complete winner documents that include providing Sponsor with a valid Social Security number before the Grand Prize will be awarded. Prize awards subject to any company policy of employer (as applicable). An IRS Form 1099 will be issued to the Grand Prize winner. (The Weber® and SmokeFire® trademarks are used solely for purposes of prize identification. No endorsement, sponsorship, affiliation, or association of any kind is intended or implied by such use.)
The five regions (each a “Region”) are as follows: Region I: New York, New Jersey, Maine, Massachusetts, Connecticut, Vermont, Rhode Island, New Hampshire, Pennsylvania, West Virginia and Delaware; Region II: Virginia, South Carolina, North Carolina, Georgia, Florida, Tennessee, Kentucky, Alabama, Maryland; Region III: Mississippi, Arkansas, Illinois, Iowa, Missouri, Louisiana, Oklahoma, Kansas, Texas, New Mexico, Nebraska; Region IV: Ohio, Michigan, Indiana, Wisconsin, Minnesota, North Dakota, South Dakota, Montana, Idaho, Oregon, Washington; and Region V: Wyoming, Colorado, Utah, Arizona, Nevada, California.
9. Grand Prize Drawings
On or about January 31, 2021, one winner and five alternate winners from each of the five Regions will be selected in separate random drawings from among all eligible entries received from each Region during the Entry Period. The drawings will be conducted by Eric Mower and Associates, whose decisions on all matters related to the Sweepstakes and these Official Rules is final and binding in all respects. Gastite reserves the right to disqualify any Qualified Participant or winner and may refuse to award a prize to a person who is not eligible or has violated a rule, gained unfair advantage in the Sweepstakes, or obtained winner status using fraudulent means. In case of a dispute about the identity of a Qualified Participant, the Grand Prize will be awarded to the natural person to whom the email address is assigned by the internet service provider responsible for the domain associated with the submitted email address. If a winner is found to be ineligible or not in compliance with these Sweepstakes Official Rules, that winner will be disqualified, and an alternate winner will be awarded that Grand Prize. Each winner will be notified by telephone and/or email. Inability of Sponsor to contact a winner by telephone within seventy-two hours after selection may result in disqualification of that winner and an alternate will be awarded the Prize. The Grand Prizes will be sent to the winners at the address provided in the Prize Claim Documents by freight, and date of delivery to be coordinated after the winner has been notified and accepted a Grand Prize. If a Grand Prize is returned as undeliverable, that Grand Prize winner will be forfeited, and an alternate winner will receive that Grand Prize.
10. Odds
The odds of winning a Regional Prize will be determined by the total number of eligible entries received for that Region.
11. Winner Verification
The winner must comply with these Official Rules and must sign and return an Affidavit of Eligibility, Liability, and Publicity Release (where lawful) (“Winner Documents”) within five business days after the date a winner receives notice of the award that includes his/her Social Security number (for purposes of issuing an IRS Form 1099 and CSST Certification Number). Winners must complete and return the IRS Form W-9 sent with the Affidavit at the time he/she returns the Affidavit. Gastite and Eric Mower and Associates reserve the right, in their sole discretion, to condition the award of a Grand Prize on the winner establishing to Gastite’s and Eric Mower and Associates’ satisfaction that he/she is a Qualified Participant and participated in the Sweepstakes in compliance with these Official Rules. If a winner cannot be contacted, fails to sign and return the Affidavit within the required time period, or the Grand Prize/Notification is returned as undeliverable, such winner will be disqualified and forfeit the Grand Prize without compensation of any kind. If a Grand Prize is forfeited, Gastite, at its sole discretion, may select at random an alternate winner from among the remaining eligible Qualified Participants.
12. Additional Grand Prize Information/Terms and Conditions
Winners are solely responsible for all taxes, including without limitation federal, state, and local income taxes and other fees and expenses associated with acceptance of the Grand Prize, whether or not specified herein. No substitution, assignment, or transfer of the Grand Prize is permitted, except by Sponsor, who reserves the right to substitute a Grand Prize with another prize of equal or greater value if the Grand Prize is unavailable for any reason.
13. Publicity
Except where prohibited by law, by accepting a Grand Prize, the winner grants Sponsor a perpetual, worldwide, fully paid-up, royalty-free, transferable license to use, reproduce, display, distribute, perform, and create derivative works of the winner’s name, photograph, voice, biographical information, and/or likeness without further authorization, compensation, or remuneration of any kind for advertising, promotion, publicity, and any other purposes in any and all media now or hereafter known throughout the world.
14. General Conditions
Sponsor reserves the right to suspend, cancel, or modify the Sweepstakes if any factor beyond Sponsor’s control impairs the integrity of the Sweepstakes such that it cannot be conducted as originally planned, as determined by Sponsor in its sole discretion. In such event, Sponsor will select a winner in a manner determined by Sponsor in its sole discretion to be fair, appropriate, and consistent with these Official Rules. Notice of such action by Sponsor will be posted at www.gastite.com/rules.
15. Release
Sponsor is not responsible for any injury, damage, or loss of any kind arising out of your participation in the Sweepstakes. By participating in the Sweepstakes, Qualified Entrants release Sponsor, prize supplier and their respective affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, and employees (“released parties”) from and against any or all claims, losses, injuries, or damages resulting from your participation or attempt to participate in the Sweepstakes or your acceptance, possession, receipt, or use or misuse of a Grand Prize. You further release, discharge, and hold Released Parties harmless from:
(i) technical failures of any kind, including without limitation the malfunctioning of any computer, cable, network, hardware, or software;
(ii) the unavailability or inaccessibility of any transmissions or telephone or internet service;
(iii) unauthorized human intervention in any part of the entry process or the Sweepstakes;
(iv) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries; or
(v) any injury or damage to persons or property, including without limitation a Qualified Participant’s or any other person’s computer or mobile/wireless device, hardware or software, which injury or damage may be caused, directly or indirectly, in whole or in part, from Qualified Participant’s participation in the Sweepstakes.
16. Disputes
By participating in the Sweepstakes, each Qualified Participant:
(i) agrees that any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or the awarding of a Grand Prize, will be resolved individually, without resort to any form of class action, and by a federal or state court of competent jurisdiction, and expressly consents to the personal jurisdiction of such courts and waives any right of change of venue or like right;
(ii) agrees that any and all claims, judgments, and awards will be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and
(iii) hereby waives all rights to claim punitive, incidental, exemplary, indirect, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules will be governed by, and construed in accordance with, the laws of the State of Tennessee without giving effect to any conflict of law rules.
17. Privacy
Information collected from Qualified Participants is subject to Sponsor’s Privacy Policy available at www.gastite.com/us/privacy_policy.html.
18. Winners’ Names
For the names of the Grand Prize winners, mail a self-addressed, stamped envelope (“SASE”) to: FlashShield®+ Certified CSST Contractor Sweepstakes, c/o Eric Mower and Associates, 211 West Jefferson Street, Syracuse, NY 13202.
